Human Rights Law: Fundamental Rights and Freedoms

Human rights law aims to protect the fundamental rights and freedoms that every individual is entitled to by birth. At KAŞIKARA Law Firm, we provide comprehensive and high-quality legal services in the field of human rights law. Our expert team diligently works to protect individuals' rights and ensure justice.

Definition and Scope of Human Rights

Human rights are based on the principle that all humans are born equal and free and are entitled to enjoy fundamental rights and freedoms without any discrimination. These rights are guaranteed by international treaties such as the United Nations Universal Declaration of Human Rights and the European Convention on Human Rights.

Fundamental Rights: Fundamental rights include the right to life, the prohibition of torture, the prohibition of slavery and forced labor, the right to a fair trial, freedom of expression, freedom of religion and conscience, and the protection of private and family life.

Freedoms: Fundamental freedoms, such as freedom of thought, conscience, and religion, freedom of expression, and freedom of assembly and association, allow individuals to live freely in democratic societies.

National and International Legislation

Human rights law is regulated by a series of national and international legislations. In Turkey, human rights are protected and guaranteed by the Constitution and relevant laws. Internationally, treaties and protocols adopted by the United Nations, the Council of Europe, and other international organizations play a crucial role.

Constitution: Article 2 of the Constitution of the Republic of Turkey states that the state is a democratic, secular, and social state governed by the rule of law, respecting human rights. Article 10 emphasizes that everyone is equal before the law without any discrimination based on language, race, color, gender, political opinion, philosophical belief, religion, sect, or similar grounds.

International Treaties: Turkey is a party to several international human rights treaties, including the European Convention on Human Rights (ECHR) and the United Nations Universal Declaration of Human Rights. These treaties form the basis of human rights protection mechanisms in Turkey.

Human Rights Violations and Legal Assistance

Human rights violations occur when individuals' fundamental rights and freedoms are infringed upon. These violations can be committed by state organs, private individuals, or organizations. At KAŞIKARA Law Firm, we provide legal assistance and representation services to our clients in cases of human rights violations.

Remedies: There are national and international remedies available for human rights violations. Nationally, individuals can apply to the Human Rights and Equality Institution of Turkey (TİHEK), the Ombudsman Institution, and the Constitutional Court. Internationally, they can apply to bodies such as the European Court of Human Rights (ECtHR) and the United Nations Human Rights Committee.

Legal Support: We provide legal support to individuals who have suffered human rights violations to ensure their rights are protected and justice is served. This includes identifying the violated rights, collecting evidence, preparing application files, and managing the application processes to relevant authorities.

Education and Awareness

Education and awareness-raising activities are crucial for the protection and development of human rights. At KAŞIKARA Law Firm, we organize training programs and seminars to increase human rights awareness and ensure the effective use of rights.

Training Programs: We organize human rights training programs for lawyers, public officials, civil society organizations, and individuals to raise awareness about rights and freedoms.

Awareness Campaigns: We conduct various campaigns to raise awareness in society about human rights. These campaigns contribute to increasing public awareness of the protection of human rights and the prevention of violations.
