The Constitutional Court decided that the rejection of the administrative application for compensation for the damage caused by the inability to access the property due to the statute of limitations violated the right to an effective application in connection with the right to property. In its decision dated 28.07.2022, the Plenary Session of the Constitutional Court decided that the right of effective application, which is regulated in Article 40 of the Constitution, has been violated in connection with the right to property, which is guaranteed in Article 35 of the Constitution.
